Natural Resource Governance Institute (NRGI) telah menyiapkan satu catatan singkat mengenai berbagai hal krusial yang sedang dihadapi Indonesia terkait revisi undang-undang migas yang sedang disiapkan oleh Dewan Perwakilan Rakyat (DPR) dan pemerintah. Di dalam dokumen ini kami berbagi perspektif, berdasarkan pengalaman dan riset global kami, mengenai opsi-opsi kebijakan yang ada untuk mencapai tujuan yang penting bagi sektor migas. Tujuan-tujuan tersebut antara lain menggairahkan investasi, memperkuat Pertamina, pajak migas yang adil, mengurangi resiko korupsi dan mendukung akuntabilitas dan tatakelola yang baik.

Salah satu pertanyaan paling krusial yang sedang dibahas oleh DPR dan pemerintah adalah, bagaimana membuat struktur lembaga yang mengelola eksplorasi, produksi, dan penjualan minyak Indonesia? Negeri ini sedang mencari satu sistem yang mendukung gairah investasi, pemperkuat BUMN energi dalam hal ini Pertamina, sebagai perusahaan migas papan atas, memperkuat pengawasan dan mengurangin resiko korupsi. Berdasarkan konsultasi penulis dengan para pemegang kepentingan (stakeholders) di Indonesia, catatan ini menjelaskan empat unsur kunci di dalam pilihan ini, yaitu:
  • Struktur kelembagaan dan peran Badan Usaha Milik Negara (BUMN)
  • Rejim fiskal migas
  • Transfer-transfer dana minyak dan gas di tingkat sub-nasional
  • Mekanisme-mekanisme transparansi
